Mr. Opert sits on the firm’s management committee and he has spent his whole legal career with K&A. His practice has primarily focused on representing mortgage lenders in multifamily housing financing transactions under various programs, including loans purchased by Fannie Mae, Freddie Mac, HUD and conduit programs. Mr. Opert started working on Fannie Mae DUS transactions around the time of the inception of the program. With 30 plus years of experience working on DUS transactions, he has extensive knowledge of the history of this program including having worked closely with in house Fannie Mae counsel on client matters and as a member of numerous outside counsel subcommittee groups. Mr. Opert has expertise in dealing with various property related features that impact financings, including but not limited to, ground leases, commercial leases, TIC structures, preferred equity, mezzanine debt, joint ventures, funds with complex capitalization structures, fractured condos, amending and restating loans and 1031 exchanges. Mr. Opert is also experienced in affordable housing matters including transactions with HAP contracts, subordinate financing, restrictive covenants and tax abatements. Mr. Opert has also assisted clients over the years in establishing their own proprietary loan programs. In addition to representing lender clients in transactional closing matters, Mr. Opert has also rendered advice and counsel over the years in corporate and regulatory matters. Mr. Opert also represents clients in connection with structuring and drafting loan commitments and providing counsel on loan servicing and asset management related issues. In addition to his lending practice, Mr. Opert has also represented developers and property owners in commercial real estate acquisitions and financings with respect to both affordable and market rate projects.
